A federal judge has denied a request by Claudia Hoerig to have her murder charges dropped.
The 54-year-old Hoerig claims the state violated her right to a speedy trial.
Judge John Adams in his ruling says it’s premature to dismiss a state court case on speedy trial grounds before the case is actually argued.
Hoerig will go on trial January 19 for the murder of her husband, Air Force Major Karl Hoerig in 2007.
After the death of her husband, she left to Brazil where she fought extradition for 11 years.
On September 6, Hoerig turned down a plea deal in the case.
