LIBERTY TOWNSHIP, Ohio (WKBN)- Two mental evaluations have been ordered for the man accused of shooting a driver in Liberty, and then getting into a shootout with police.

Kevin Mallard, 55, is facing several charges, including attempted murder. He’s suspected of shooting a Warren man in the face before getting into a shootout with police.

A judge had reviewed medical records provided by Mallard’s defense. The records are sealed so no one can see them. It’s an attempt to establish a basis for allowing Mallard to plead not guilty by reason of insanity.
The records were enough for the judge to order evaluations of Mallard’s mental health.

“I think it’s an important part of our case that we get to present some evidence as to his mental capacity at the time of this incident,” said Attorney Eugene Fehr, a public defender.

The evaluations will check Kevin Mallard’s ability to understand what’s going on in court and his mental abilities at the time of the incident.

Mallard will be back in court during October.
