The grand jury issued the indictment against Tracye Peno Thursday morning. The grand jury, however, chose not to indict Peno on a charge of aggravated vehicular assault.

Peno was driving very slow on July 9th on East Market Street in Warren. When Sgt. Joe O'Grady opened the driver's side door and attempted to stop the car.

Police say Peno sped up and while the officer was still hanging on the car, Peno crashed into the cruiser.

O'Grady and Officer Thad Stephenson received minor injuries.
