Protection Order Not Enough for Slain Teacher

Attorney-at-law Chris Maruca said a protection order is only as good as the paper it is written on.

"If they want to get to you, unfortunately, they will," Maruca said.

Murder suspect Robert McLaughlin has a history with his alleged victim, Stacey Sutera, 40, of Canfield. He is accused of shooting Sutera to death in Wednesday morning in the parking lot of her Carriage Hill townhouse apartment complex as she was getting ready to leave for work.

McLaughlin had been convicted in late 2010 of stalking Sutera. Last November, he was convicted in Mahoning County Common Pleas Court of pandering obscenities and weapons charges from the same incident. He spent some time in jail, but was sentenced to probation and ordered to complete an anger management program.

When authorities searched McLaughlin's home in 2011, they found pictures of Sutera, dozens of guns and other obscene materials.

McLaughlin had also been issued a civil protection order and wasn't allowed to own weapons or have any contact with Sutera.

"There's no way you're going to be able to protect somebody 24-7. Could she have taken precautions? Sure, and if she took every single precaution, there's no way she's going to be able to defend herself against somebody carrying a gun," Maruca said.

Someplace Safe is the domestic violence agency in Trumbull County. They encourage victims to document all stalking incidents, save any letters or voice mails and safety plan for their lives.

"Often times it's a matter of sometimes changing the route that you go to work, where you park," said Linda Baer, a legal advocate supervisor with Someplace Safe.

Baer made a chilling discovery when looking at a suit Sutera filed last year against McLaughlin.

"She had filed a civil lawsuit on him Feb. 8,2011, and today is Feb. 8, 2012," Baer said.

Baer said stalkers often focus on certain dates or occasions, but Maruca said you can't predict what a sociopath like McLaughlin might do.

"Either he's going to surrender, because he accomplished what he wanted to accomplish, or he's going to go down guns a-blazing," Maruca said.

Baer tells women and victims of domestic violence to document, document, document. The bigger and longer the paper trail, the better the case can be built against a stalker in court.

Maruca and Baer agreed that most people follow restraining or protection orders and are deterred by criminal charges, fines and jail time. But as Wednesday's incident shows, there are always going to be some people out there with no regard for the law, and no respect for human life.

dewey : ".If you are walking down the street with a gun in a holster OPEN or in your hand,OPEN, a policeman will probably stop you and chat a while,but can't arrest you for that act." - I think if you have it in your hand they can charge you with 'brandishing'; but yeah, open carry is legal in Ohio. Sadly, anyone who open carries is going to be harassed by every cop who sees him.

Fightforlife, Want my opinion? get a gun and load it and carry it anyway.Wouldn't you rather be tried by 12 than carried by 6 ? How much do you think a crook worries when he carries a gun to kill little old defenseless ladies in church parking lots? And you are correct about the money angle. My class was one hundred dollars.The Constitution of these United States says "the right of the people to keep and bear arms shall not be infringed." That says we already have a God given right to protect our selves, and the Constitution protects that right. No one ever repealed that amendment, so it is still law.They TRY to destroy it every day, but so far, they haven't been able. So, this begs the question, "if I already HAVE the right,why do I have to pay money for it"? Start thinking about it, folks.

You're right on the beam, Les Nessman guy, but a concealed weapon permit is not necessary to carry a gun in Ohio.Ohio has NO LAW AGAINST OPEN CASRRY.I stress the word "OPEN"....I learned this in my concealed carry class, which happens to be taught by two excellent police officers.This may start some people thinking, and maybe investigating a little further.If you are walking down the street with a gun in a holster OPEN or in your hand,OPEN, a policeman will probably stop you and chat a while,but can't arrest you for that act. If you are walking to your car and carrying a gun in that manner,probably no one is going to ask you about it, or try to rob or otherwise bother you. You may get some puzzled looks, but looks never hurt anyone as far as I know.

I feel sorry for poor Stacey and her family. Im going truh, what she went truh. I too, have a stalker. Im fearing for my life.... Im scared. I want to get self-defence training and a licence to carry, but that cost money, -i dont have-. My prayers are with Stacey's family and all the other young woman, who have lost their lifes. I believe all convicted stalkers should wear a permant ancle bracelets....

Folks, this is proof once again that there is nothing between you and your attacker. Laws do not stop those that break the law. The threat of jail does not stop those with nothing to lose. The Police do a fine job and their job is not to prevent your death. Your only defense against an attacker like this is the weapons and training you provide yourself as a responsible adult in a strategy of self defense. Arm yourselves and train to fight, defend and protect yourself and your loved ones. There is NOTHING to protect you beyond what you provide yourself. Don't be a victim. Arm, train and defend. God speed to Stacey and my hopes and prayers that you all are safe.

What ever happened to Innocent until proven Guilty? I love how the press automatically tries and convicts a person before he ever has a say. Just because she had an issue with this man, there is no proof yet that he was the one that did it for sure! There is things called proof!!! hello people! Let the man have his day in court before slandering the guy! Yes, in all likelyhood he did do it...but there is no proof yet...just a hunch.

so according to maruca if someone wants to kill you there's nothing the authorties can do about it. i guess if someone threatens your life it's perfectly legal? this, whatever the hell he is, needs to be caught quickly, taken off the street to protect others, give him a four hour trial and then hung immediately. do we all need to carry guns at all times? i know, let's make guns illegal to have and then criminals won't be able to get them. right? what?

Relying on the police or the court system for protection will end up with you dying every time. The only thing that would have stopped this McLaughlin nutcase is a bullet through his head.

What if she carried a gun to defend herself and was trained how to use it? It may not be a 100% guarantee of safety, but it's good protection. If anyone, especially women, has a stalker after them they should consider getting a concealed carry permit and get training on handgun use.

First off, my heart goes out to this womans family and friends, Second, why was this guy not in prison ? I'll tell You why,because this country has avery weak and pathetic justice system. He's been stalking her, and he was out on the street. Sad, very sad, all I know is our justice system needs a total rework, from the ground up.
