Courts, Witnesses Cautious in St. Dom's Murder Case

Jamar Houser appeared in court Monday to face charges in the shooting death of 80-year-old Angeline Fimognari last month. He wasn't the only member of his family appearing in front of a judge.

His parents, John Houser and Frances Cianciola, were both arraigned on felony charges of retaliation for allegedly threatening a witness in the case.

"Because that witness did cooperate with us, and provide information, they then singled him out," said Jay Macejko, Youngstown city prosecutor. "And at least levied a threat or tried to strike back at him because of his involvement."

Jamar Houser is accused of shooting Fimognari Jan. 23. He was arrested Jan. 29. His parents were arrested last week.

And the couple's threat is not the only one that has the court and prosecutor's office on its toes. Security was very tight at Jamar Houser's own hearing.

"There are some very strong feelings in the community about this case, and we just wanted to make sure that no one acted out of emotion or acted irrationally and would try to do something, whether to a witness, to the defendant, or to anyone associated with this case," said Macejko.

Some witnesses have even felt threatened enough to leave the Valley until things cool down.

"Some witnesses were allowed to leave the area, but they are in contact with us," said Macejko. "Anytime anyone feels uncomfortable, they should contact the county prosecutor's office, the city prosecutor's office, or the detective division of the Youngstown Police Department," said Macejko.

In court Monday, Jamar Houser decided to waive his right to a preliminary hearing on his charges.

"We expected and certainly we prepared as if the hearing would go forward," said Macejko. "We did have witnesses present that would have established probable cause for this offense. Rather than go through that, the defense chose to waive the preliminary hearing, and asked that the matter be sent to the grand jury."

Macejko said that could take between two to five weeks for them to hear evidence. And the grand jury will be handed the task of determining an indictment for Jamar Houser.

Family members of Fimognari were present in court Monday and had hoped to hear some details of the case.

"Now we have to wait for the grand jury, and that's it," said Gary Milano, Fimognari's nephew. "You know, we were kind of disappointed."

Jamar Houser's parents are due back in court on Feb. 16. Their charges each carry a possible one- to five-year prison sentence. John Houser's bond was set at $250,000 and Cianciola's at $100,000.

I tell you what if my child was in any trouble i will defend him with all of my power AND ITS YOUNGSTOWN EVERYBODY AND THEIR MOTHER WAS TALKING ABOUT THAT MONEY ON THE UNKNOWN MURDER, he or she that provided the false information got scared and left because they found out that they know who he is. I would leave too if I lied on someone for money and they were getting the death penalty and they found out who i was. I would leave and move too the next city. Aspecialy when he's innocent.. and me and my friend and family went to his hearing and thats why its going too take 5 to 6 weeks for it to get to the grand jury. Im just saying if he did it wheres the prof really they have nuthing on this guy. And if they did it would not take 5 to 6 weeks to get to the Grand Jury.

jesusforgives7...there is a huge difference between defending and supporting you child if he/she would be "accused" of murder versus threatening a witness. If the witness is providing information on the wrong guy then why did they feel a need to threaten the witness? Some things to think about...question: how do you know they do not have the right guy? If you have some knowledge then maybe you should reveal that info to the police?...just another thought...

if your child was accused of murder with no evidence at all you would be doing the same because if you didnt you wouldnt love them. i cant see any of you leaving you child behind to die for something like this. defend your children is perfect love it wouldnt be love if the parent wasnt defensive at all. you couldnt tell me you wouldnt defend your children in cases like these.

and im not saying that what took place last month at that wonderful church was right but they don't have the right guy, and all im asking why down him and degrade him im saying why dont every body pray for both sides of the family. Astead of degrading one and blessing the other one, oh and they didnt get no infomation or else would of been charged and setting a day for his death upon this all. He's in jail because of his other charged i quote he's being "accused" I was at the court monday to see the public record and they wouldnt even show the video they had no evidence the judge was confussed his self.

Not once did I say the teachers need to raise there STUDENTS, and I spoke the words in the bible in terms that you all would understand, and I go to a perferct church I represent the St. Patrick Catholic Church on Oak Hill. Been a member sence 1978 brought up and baptised in that church.

Hmmm...interesting trail to follow. Folks like to use the church and biblical quotes to hide behind when the chips are down and that is not what religion and belief are about. If you follow the basic principles in your life there is no need to use the aforementioned as excuses and reasons. This kid is a felon, plain and simple. His parents are felons, plain ansd simple. Do not use The Book to hide behind to reason this out. The schools are only able to do what they can because kids are now "protected" by parents that, like Mook's, believe their babies do no wrong. It's in Y'town, it's in Boardman, it's in Mooney. Adults have a skewed perception of life and they are all about "me me me" around here and that translates directly to their kids. There is no respect for fellow man, neighbors, classmates. If this kid did the crime then let him face the jury, be it in court and after death, if that ends up being the case. We all have options, some of us make better choices, some don't. Yes, there are numerous factors in how we percieve life and live it but no one is born into killing. Jamar/Mook made his choices and now he is living with them.

Jesusforgives7-- You better find new a church!!! Not one that says a bunch of bull. The word says The rain fall on the just and unjust. There is no such thing in the bible that says your days are numbered.He is a crap bag. There was a $10,000 reward to get the information they got. It worked. Let him ask God to be forgiven, then close his eyes and meet him face to face on judgement day. The thief on the cross asked to be forgiven. But God still let him die. The teachers are not responsible for the children. They are can't even yell at them. The parents charge them in a court. This is what would have happened here. His parents think their baby does no wrong. As You can see the parents are doing it now when it is murder. I say lets put the him down and the parents away for the rest of their life. They are low life trash, and You want to defend all of them.

Just kinda lookin' at your profound abilities with lqanguage, spelling, and grammar in your barely decipherable comments.Aside from that,where is it written that the teachers are supposed to raise the kids? It's not the schools job to raise kids, it is the duty and JOB if you will,of the parents.Of course with a couple losers like he has for parents,is it any wonder he has been in trouble since he was fourteen years old.Yeah, he's a real victim.All the lowlives are "victims" arem't they?

teachers arnt giving education to kids like there suppost to... come on now its 2009-2010 teachers dont care as long as their checks coming in every two weeks they can care less about the students and i learned that first hand and weir in youngstown theres only a few teachers that care about our children. He made it threw elementry and high school.. and got his H.S.D he was the one that always got bullied and chased home. but you wouldnt know that because your to buisy judging him. people had to fight for him he was a little on the heavy side and kids always picked on him. he was never a bully just always da victim and his parent brought him up well thats why he finished school. They made sure he went to proms. They bought him cars. Yes their going to protect their son because just like the next mother i would expect them to do that but in this case its serious and its not that their letting him get away with murder he's innocent and the courts know... the prof is no where. No video, no evidence, no confession and no witnesses. Think what you want but you cant do nothing but sit back and grind your teeth. Wheres the motive he was just about to get paid plus he was on foot.. jamars nevers on foot he drive threw the town allday their wasnt even a get away car and it was to far away from home... theres no MOTIVE
