A trial to challenge Ohio's death penalty got underway Monday in U.S. District Court.

The proceedings are part of condemned killer, Kenneth Biros' challenge, of the state's lethal injection process.  Biros says some of the drugs used will cause a painful death. The state says there's little evidence of that.  Testimony is underway to determine whether Biros can proceed with a full-blown constitutional challenge of Ohio's execution procedures.

Biros was sentenced to die in 1991 for murdering and dismembering 22 year old Tami Engstrom of Brookfield.  He later spread parts of her body in Pennsylvania.

Even if it a little painful, compare his pain to the pain that his victim went through and then tell me which one is more unconstitutional. I hope he gets the needle and it causes excrutiating pain that somehow prolongs his life and he continues to be in pain for years to come. Sorry if I sound a little bitter but where is the justice here?

I went to High School with Tammy. It is a shame that this very sick man even has the right to take a breath after what he did to her. I also was friends with her late husband after he purchased a bike for thier son. He has the nerve to say that the leathal injection process would subject him to a painful death, excuse me, what did he subject Tammy Engstrom too?! The legal system is their for people who have been wrongly accused, there is NO doubt about this man's guilt as evidenced by his own admission and the evidence! Put this man to death and let the Engstrom/Heiss family have thier long overdue closure! He has drained not only those two families emotions, but also the taxpayers money long enough!!! Joe P.
