A local attorney has filed a lawsuit against another Warren lawyer seeking a portion of a large medical malpractice verdict.

Attorney Roger Bauer filed the lawsuit in Trumbull County Common Pleas Court against Attorney Martin White, saying he is owed part of a verdict. The lawsuit does not specify which case, but sources say it has to do with the record $13.9 million in damages awarded by a jury earlier this month in a medical malpractice case concerning, Haley Cobb, a Leavittsburg girl with cerebral palsy.

Bauer claims in the suit that he is due more than $25,000 for a contingent fee for referring the Cobbs to White, who specializes in the malpractice cases.

sunny, furnaceman1 is correct, the statute of limitiations does not expire for children until they reach the age of 18. You may still have a case and perhaps should see a lawyer. If nothing else it may make you feel better but take a good shower when you return home.

Oh, and by the way, your prayers, visiting the cemetary, and cheerishing memories don't take away the fact that you have lost your spouse (child, parent, or other loved ones) due to the NEGLIGENCE of someone that is educated, and suppose to provide the PROPER care to keep you healthy, safe, alive...it is hard enough to lose them when nothing could have been done to save them, but when megligence is involved, there definately is blame, and therefore, there should be compensation!

furnaceman1, my children are now 16 & 17, I might look into it, but I don't know - they are well-adjusted, happy, and have a great outlook on life - I am not sure if having to live through knowing all of the details and everything they would have to experience emotionally is worth it now...hind-sight hurts, but I should have sued when he died!

db2sub1, I have never talked to an attorney about my husband's death - he didn't die of viral pnemonia - he died of COMPLICATIONS OF BACTERIAL PNEMONIA - they were treating him for viral instead of bacterial - as soon as he went into a coma, they admitted to mis-diagnosing him, and in turn, mis-medicating him.

sunny, sorry to hear of your loss but viral pneumonia is usually not serious, not life threatening, and rarely treated with anything besides supportive therapy. Bacterial pneumonia is life threatening. Are you sure that you have your facts straight or is this BS from some misinformed bottom feeding lawyer?

Tipper, I hope you win your case if there was malpractice involved! My first husband was mis-diagnosed with "viral" pnemonia, when he infact had bacterial pnemonia - meaning he was given the wrong meds, and by the time they caught their mistakes, it was too late - he was already in a coma and brain dead...I wish I had sued now because I was left with two babies that could have used the money for college and a good start in life - that was 15 years ago - the "I wish I had" really means nothing now!

Tipper, no one can bring back your husband and to put your hopes for solace in a lawyer's hands is misguided. Pray, visit the cemetery often, and cherish the good times but forget the lawyer; he will only keep your wounds open.
