He remains on Ohio's death row for the murder of Tammy Engstrom eighteen years ago.  But it's not clear whether he can mount a new appeal to stop his execution.

The high court left the door open to challenging lethal injection procedures in states such as Ohio, where there have been problems administering the drugs.

Last week, the Supreme Court ruled that Kentucky's lethal injection procedures were not overly cruel.
