As we told you last week, the Ohio Supreme Court ruled Aey was not qualified to run despite his claims he had accumulated enough college credit for the position.
Wednesday, Aey's lawyer, Robert Rohrbaugh, told the Board of Elections he will ask Justices to reconsider their decision claiming there's new evidence they haven't seen yet.
Wednesday morning the Board of Elections agreed to take no action on the issue. We're told the Board will continue to follow last week's ruling that Aey is not a candidate until they're told otherwise.
At this point, Rohrbaugh admits there's no guarantee Justices will even let him make his argument, let alone reverse their earlier decision.
