The state has answered the request made by attorneys for two defendants in the Oakhill Renaissance Place by filing a Bill of Particulars.
The Bill of Particulars, dated Aug. 31, shows the evidence the state has accumulated against business executive Flora Cafaro and Atty. Martin Yavorcik. Both defendants are charged with one count on money laundering.
According to the bill, both defendants acted while knowing "the property involved in the transactions was the proceeds of some form of unlawful activity and did so in a manner calculated to conceal or disguise the nature, location, source, ownership or control of the property or to avoid a transaction reporting requirement..."
The bill states that during Yavorcik's unsuccessful 2008 campaign for county prosecutor, Flora Cafaro donated $15,000 to the campaign that were not claimed in either election filings or on Yavorcik's 2008 income taxes. The check, dated March 20, 2008, was issued by the Cafaro Company and signed by Cafaro.
According to the bill, an invoice from "Martin Yavorcik Trial Attorney" dated the same day, was made to look like it was for legal services on Feb. 20, 2008 for "William M. Ferraro/American Gladiator Fitness Center." In the bill, Ferraro denied meeting and using Yavorcik for legal services.
The bill states that Yavorcik issued a check March 21, 2008 for $15,000 to Global Strategies Group, which is a political consulting organization. This group conducted a political survey regarding Yavorcik's candidacy.
"Yavorcik is the same attorney that was solicited by Anthony M. Cafaro Sr., his brother, John J. Cafaro, and his sister, Flora Cafaro, and backed financially in an amount totaling $120,000 for the purpose of removing Paul Gains from office following the much-publicized attempt which delayed but failed to block the move from the Cafaro-controlled Garland Plaza site to Oakhill," the bill states.
According to court documents, Cafaro is now being represented by Atty. J. Alan Johnson. Johnson is out of town and could not be reached to confirm this detail or comment on the case. Multiple attempts to reach Yavorcik's attorney, J. Gerald Ingram, were unsuccessful.
A 41-page, 73-count indictment was filed in July. Charges were also filed against developer Anthony Cafaro, Sr., Commissioner John McNally, former Treasurer John Reardon, Auditor Michael V. Sciortino, former Job and Family Services Director John Zachariah, Ohio Valley Mall Company, Cafaro Company and Marion Plaza Inc.
